Line Drawn| Abbott Asserts Texas’ Constitutional Right to Self-Defense

Temperatures are rising between the state of Texas and the federal government as Gov. Greg Abbott has issued a statement on Texas’ constitutional right to defend and protect itself.

“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” the statement reads.

“President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary.”

The statement comes days after the U.S. Supreme Court ruled against Texas and in favor of the Biden Administration that border patrol agents can remove the razor wire and other barriers along the border.

However, Abbott has defied the Supreme Court ruling, instructing the Texas National Guard to replace the razor wire Border Patrol Agents removed.

The escalation between both the state and the White House on the proper border measures and dealing with illegal entry is setting up a major legal battle over states’ rights and federal government reach.

Abbott has asserted that President Biden has refused to enforce the current immigration laws and “has even violated them.”

“The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense,” said Abbott in the statement.

“For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border.”

Talks of another civil war have been circulating across the United States and on social media, and With the escalation in tactics by both Texas and the Federal government, talks of civil war could possibly become a reality.
